1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and SafeSpace LLC ("SafeSpace," "we," "us," or "our"), governing your access to and use of the SafeSpace platform at https://www.my-safespace.org (the "Platform").
By creating an account, accessing the Platform, or using any of our services, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, you must not use the Platform.
2. Description of Service
SafeSpace is an online platform that connects individuals ("Users") with trained, vetted professionals ("Listeners") for the purpose of providing a safe, supportive environment where Users can share their thoughts, feelings, and experiences and receive empathy, support, and a listening ear.
3. Eligibility
- You must be at least 18 years old to use the Platform.
- You must be a human individual. Accounts registered by bots or automated methods are not permitted.
- You must not have been previously banned from the Platform.
- You must have the legal capacity to enter into binding contracts.
4. Account Registration and Security
To use the Platform, you must register for an account. You agree to:
- Provide accurate, complete, and current registration information.
- Verify your email address before accessing the Platform's full features.
- Maintain the confidentiality of your password and account credentials.
- Notify us immediately at privacy@my-safespace.org if you suspect unauthorized access to your account.
- Take responsibility for all activity that occurs under your account.
SafeSpace reserves the right to suspend or terminate accounts that contain inaccurate information or that we believe have been compromised.
5. Listeners
5.1 Vetting and Training
All Listeners on the SafeSpace Platform are required to:
- Be professionally trained in a relevant field (e.g., counseling, social work, psychology, or equivalent).
- Successfully pass an identity and background verification check prior to onboarding.
- Complete SafeSpace's Listener training program.
- Agree to SafeSpace's Listener Code of Conduct and confidentiality obligations.
5.2 Nature of Listener Support
Listeners provide empathetic support, a listening ear, and general guidance. They do not provide clinical diagnosis, therapy, psychiatric treatment, or emergency services. Interactions with Listeners do not constitute a therapist-client relationship, a doctor-patient relationship, or any other licensed professional relationship.
6. User Conduct
By using the Platform, you agree not to:
- Use the Platform if you are under 18 years of age.
- Harass, abuse, threaten, or intimidate Listeners or other users.
- Share false, misleading, or fraudulent information.
- Attempt to solicit personal contact information from Listeners outside the Platform.
- Use the Platform for any unlawful purpose.
- Upload or transmit viruses, malware, or any harmful code.
- Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
- Resell or commercialize access to the Platform without our written consent.
- Record or screenshot conversations without the express consent of the other party.
SafeSpace reserves the right to suspend or permanently ban any user who violates these rules, at our sole discretion, without prior notice.
7. Subscriptions and Payment
Access to certain features of the Platform requires a paid subscription. By purchasing a subscription:
- You authorize SafeSpace to charge your payment method through Stripe on a recurring basis at the selected billing frequency.
- You agree to Stripe's Terms of Service at https://stripe.com/legal.
- Subscription fees are non-refundable except as required by applicable law or as stated in our Refund Policy.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- SafeSpace reserves the right to change subscription pricing with at least 30 days' notice to active subscribers.
8. Intellectual Property
All content, design, logos, trademarks, and technology on the Platform are the property of SafeSpace LLC or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only.
You retain ownership of any content you submit to the Platform. By submitting content, you grant SafeSpace a worldwide, royalty-free license to store, display, and use such content for the purpose of operating the Platform.
9. Confidentiality of Sessions
SafeSpace takes the privacy of your conversations seriously. All conversations are stored securely and accessible only to you and your assigned Listener during an active session. SafeSpace staff may access conversations only for safety, fraud prevention, or legal compliance purposes.
Conversations are permanently deleted upon account deactivation as described in our Privacy Policy.
10. Medical and Crisis Disclaimer
If you are experiencing a mental health emergency, suicidal thoughts, or are in immediate danger, please:
- Call 911 or your local emergency number.
- Contact the 988 Suicide and Crisis Lifeline by calling or texting 988 (USA).
- Go to your nearest emergency room.
SafeSpace does not provide emergency services and is not responsible for outcomes in emergency situations. By using the Platform, you acknowledge that SafeSpace is a peer-support and listening platform only.
11. Limitation of Liability
To the maximum extent permitted by applicable law, SafeSpace LLC, its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform.
SafeSpace's total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total amount you paid to SafeSpace in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless SafeSpace LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another person.
13. Termination
SafeSpace reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, third parties, or the interests of SafeSpace, or for any other reason at our sole discretion.
You may terminate your account at any time by using the account deactivation feature within the Platform. Upon termination, your messages and personal data will be deleted in accordance with our Privacy Policy.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, USA, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Tennessee in accordance with the rules of the American Arbitration Association (AAA).
You waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Changes to These Terms
We reserve the right to update these Terms at any time. Material changes will be communicated by email or a prominent notice on the Platform at least 30 days before taking effect. Your continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
